REGIMENTO DOS ENCABEÇAMENTOS DAS SIZAS DESTE REYNO.

Mandado Imprimir PELO CONSELHO DA FAZENDA. Lisboa. Com as Licenças necessarias. Por Antonio Craesbeeck de Mello, Impressor de S. A. Anno 1674.

In fólio peq. de 29x19 cm. Com [iv], 58 págs. Encadernação da época em pergaminho flexível, com o seguinte título escrito à pena na pasta anterior: «Regim[en]to pera o Escrivão das sizas desta V[edori]a de Thomar».

Folha de rosto com uma gravura ao centro, com as armas do Rei D. Pedro II de Portugal, realizada por I. Ieghers. Encontra-se decorada com motivos emblemáticos. Apresenta iniciais decoradas, Cabeção com o Trigrama Sagrado ao centro e florão de remate emblemático, em estilo barroco, com no fim do índice.

Exemplar com ex-libris da Livraria Castro na capa anterior; nota manuscrita coeva na frente da segunda folha de guarda, que indica os capítulos onde constam as obrigações dos escrivães das sizas e dos recebedores; assinatura de posse na folha de rosto; sublinhados e anotações marginais coevas, ao longo do texto; e acastanhamento das folhas desde a página 33 ao fim, em que as notas apresentam efeitos ferrogálicos sobre o papel.

As folhas preliminares incluem o Alvará do Rei D. Pedro de 16 de Janeiro de 1674 e as licenças da Inquisição de 7 de Novembro de 1673 assinada por Fr. Pedro de Magalhães e outros, do ordinário assinada pelo Bispo de Martíria e do Desembargo do Paço, assinada por Magalhães de Meneses e outros.

É a 1.ª edição deste regulamento relativo ao pagamento da sisa. Sobre os artigos das sisas a 1.ª edição foi publicada em 1512, a 2.ª edição viu a luz com o seguinte título ARTIGOS DAS SIZAS imprimidos por mandado d’Elrei D. João III. Lisboa, por German Galharde 1542. Posteriormente foram publicadas as seguintes edições: Lisboa, 1566, Lisboa, 1678, Lisboa, 1702, Lisboa, 1816.

Muito rara e importante para o estudo da evolução do sistema fiscal em Portugal e das implicações sociais dos impostos.

As Sisas eram um imposto indirecto que recaía sobre as mercadorias que entravam em contrato de compra e venda e troca. Aparecendo inicialmente como imposto municipal extraordinário para socorrer a despesas extraordinárias. Depressa se transformou em imposto régio também provisório, e a partir do reinado de D. João I com carácter permanente e geral, de que nem o Rei ou a Raínha estavam isentos. A importância deste imposto pode verificar-se logo no reinado de D. João I, em que o total arrecadado por aquele imposto representou cerca de três quartos de todas as rendas da coroa. Foi, por isso, várias vezes regulamentado e alterado para melhor satisfazer as necessidades dos vários momentos históricos (Dic. Hist. Port., VI, p. 1)

As Sizas foram estudadas por Teixeira de Magalhães na obra: A Siza e o Imposto sobre as Sucessões e Doações, Coimbra Editora, 1935, pág. 13, em que nos diz:

«O imposto da siza é antiquíssimo entre nós. Diz Frei Joaquim de Santa Rosa de Viterbo, no seu Elucidário, que o tributo da siza introduziu em Castela El-Rei Dom Sancho no ano de 1285, e daí passou a Portugal. E tal desenvolvimento teve este tributo que para ele houve o seu «Regimento» com os desenvolvidos «Artigos das Sizas», que continham as normas reguladoras deste imposto, assaz variado e da maior complexidade. É certo que abrangendo as transmissões por título oneroso, recaía tanto sobre a propriedade imóvel como sobre a mobiliária — móveis e semoventes — e sem nenhuma uniformidade: a taxa variava segundo os bens sobre que incidia e ainda segundo as terras e a naturalidade do comprador e do vendedor. Era assim um dos grandes rendimentos do Estado, e muito maior seria se o seu produto entrasse inteira e integralmente no tesouro público. O grande reformador Mousinho da Silveira, pelo decreto de 19 de Abril de 1832, artigo 1.º, determinou que «desde o 1.º de Janeiro de 1833, se não paga sisa alguma por nenhum título e sobre nenhum contrato, senão de vendas e trocas de bens de raiz».

Copy with ex-libris of Livraria Castro on front cover; coeval handwritten note on front of second flyleaf, which indicates the chapters where the obligations of the clerks and of the receivers of the “sizas” are stated; ownership handwritten title on title page; coeval marginal underlining and annotations throughout text; and browning of leaves from page 33 to end, where notes show ferrogallic ink effects on paper.

The preliminary leaves include the Alvará of King Pedro of 16 January 1674 and the licences of the Inquisition of 7 November 1673 signed by Fr. Pedro de Magalhães and others, of the ordinary signed by the Bishop of Martíria and of the Desembargo do Paço, signed by Magalhães de Meneses and others.

This is the 1st edition of this regulation regarding the payment of the “sisa”. On the articles of the “sisas” the 1st edition was published in 1512, the 2nd edition came out with the following title ARTIGOS DAS SIZAS imprimidos por mandado d’Elrei D. João III. Lisboa, por German Galharde 1542. The following editions were subsequently published: Lisbon, 1566, Lisbon, 1678, Lisbon, 1702, Lisbon, 1816.

Very rare and important for the study of the evolution of the tax system in Portugal and the social implications of taxes.

”Sisas” were an indirect tax levied on goods that entered into a contract of sale and exchange. It initially appeared as an extraordinary municipal tax to help cover extraordinary expenses. It soon became a royal tax, also provisional, and from the reign of King João I it became a permanent and general tax, from which neither the King nor the Queen were exempt. The importance of this tax can already be seen during the reign of King João I, when the total amount collected from this tax represented about three quarters of all the crown's revenues. It was, therefore, regulated and changed several times to better meet the needs of the various historical moments (Dic. Hist. Port., VI, p. 1)

”Sizas” were studied by Teixeira de Magalhães in his work: A Siza e o Imposto sobre as Sucessões e Doações, Coimbra Editora, 1935, p. 13, in which he tells us:

"The “siza” is very old tax among us. Friar Joaquim de Santa Rosa de Viterbo says, in his Elucidário, that the “siza” tax was introduced in Castile by the King Dom Sancho in the year 1285, and from there it passed to Portugal. And such was the development of this tax that it had its "Regimento" with the developed "Artigos das Sizas", which contained the rules regulating this tax, quite varied and of the greatest complexity. It is true that it covered transfers for valuable consideration and was levied on both immovable and movable property without any uniformity: the rate varied according to the goods on which it was levied and also according to the land and nationality of the buyer and seller. It was thus one of the great revenues of the State, and much greater would be if its proceeds went entirely into the public treasury. The great reformer Mousinho da Silveira, by the decree of April 19th 1832, article 1, determined that "since January 1st 1833, no “sisa” shall be paid for any title or on any contract, except for sales and exchanges of property".
