MANUSCRITO - SIGILOGRAFIA - SEC. XVI - CARTA RÉGIA DE D. JOÃO III, REI DE PORTUGAL.

Dom João per graça de Deus Rei de Portugal e do Algarve Daquem e Dalém Mar em Africa Senhor da conquista navegação e mar Etiópia, Arábia, Persia e da India. A quantos esta minha carta virem sabede que tenho feito mercê ao Senhor D[iogo] Lopes de Carvalho do meu desembargador do paço […] que esse dito mandei dar. [...] Dada em minha cidade de [?] aos 4 de Julho […] Ano do Nascimento de nosso senhor Jesus de mil e quinhentos trinta e tres anos. [1533].

1 fólio em pergaminho com dobra no pé do documento (de 25+2,5x37 cm), assinado por D. João III, com selo pendente em lacre com as armas reais desvanecidas, porém ainda com as quinas perceptíveis a uma leitura cuidada.

O documento encontra-se em bom estado de conservação e apresenta o selo (redondo em cera natural) muito desgastado, de dificil leitura, com as cinco quinas esbatidas, no entanto perceptiveis.

Carta régia de D. João III pela qual faz mercê ao doutor Diogo Lopes de Carvalho, desembargador do Paço, permitindo-lhe que largue ou retome ao seu oficio quando lhe aprouver, e que se ausente da Corte quando quizer, continuando sempre a receber o seu mantimento como se servisse continuamente as justiças. Évora, 9 de Julho de 1533.

Dom Johão per graça de deus Rei de Portugal e dos Alguarves daquem e dalem maar [...] do Suez [...] [Linha 2] da conquista Navegaçam Comércio dEthiopia, Arábia, Pérsia e da Imdia etc. Aquantos esta minha carta virem faço saber que eu [L. 3] tenho feyto merce ao doutor Diego Lopez de Carvalho do oficio de meu desembarguador do paço e pitições delle com cem mill res de [L. 4] mantimento per ano segundo tem peras provisões que elhi diso mandei dar. E avendo em respeito aos muytos serviços que o dito doutor [L. 5] Diego Lopez tem feito e ao muyto tempo que ha que serve e sempre muy bem e com toda fieldade pero elhi fazer pero mais seu [L. 6] repouso e descanso me praz que quamdo quer ese doutor quiser hir de minha corte o posa fazer sem mais per a iso [resolver c. Dicio.] outra [L. 7] licença e onde quer que elle esticer elhi sejam paguos os ditos cem mill reis inteiramente e lhe sejam levados a Roll (?) como se servisse [L. 8] na dita corte e ao regedor da casa da Supricaçam mando mando que lhes mande levar a Roll e paguar como se continuadamente [L. 9] servise em pisoa e quando ese dito doutor quiser tornar a servir o dito oficio o possa fazer e se estando em minha corte [L. 10] nom quiser tomar petições nem servir o dito oficio ey por bem que ele o faça e sem embarguo diso aja o dito mantimento pero que a mym [L. 11] praz que ele sirva o dito ofício quando quiser e tome as pitições que quiser e as que nom quiser tomar que as nom tome e [Linha 12] quamdo ele aprouver hir despachar com os outros desembargadores do paço o possa fazer quer va quer não sempre [...] o dito [L. 13] mantimento na corte e fora dela onde quer que ele estiver, ora sirva o dito ofício ora nam sirva como ele ouver por bem e posto [L. 14] que estiver fora da minha corte e sirva o dito ofício posto que muytos anos seja elle guozara de todos os privilegios [L. 15] e franquezas como se na corte andasse continuadamente servindo e como os tem e han e guozam os que [L. 16] servem. E porem mando ao dito regedor que no que a elle [joguar? ] o cumpra muy inteiramente e asy mando a todos meus corregidores ouvidores e juizes e justiças a que for mostrado que muy inteiramente elhi guardem os ditos previlegios e liberdades posto que [L. 17] nom estee em minha corte asy como se en ela estivesse e servisse pero quanto pero os ditos respeiteita e [...] justos que praiso (?) [L. 18] ouve [...] asy por bem e diso elhi mandey dar esta minha carta asynada per my e aselada com o meu selo pendente [L. 19] per a ter per a sua garda. Dada em a minha cidade de [Leiria?] a 9 dias de Julho Fernam da Costa o fez. Ano do nascimento de nosso senhor Jesus Cristo de mill e quinhentos e trinta e tres anos.

Diogo Lopes de Carvalho (c. 1460 – c. 1541) Doutor em direito civil e canónico pela Universidade de Coimbra foi jurista e desempenhou as mais elevadas funções nos tribunais superiores e no Paço. Foi, a partir de 14 de Janeiro de 1499, desembargador da corte e por especial mandado desembargador dos hospitais e capelas e a 19 do mesmo mês e ano desembargador dos hospitais e capelas em Lisboa e termo, cargo já plenamente assumido em 1500. Acompanhou, a 26 de agosto de 1499, D. Rodrigo de Castro e o licenciado Aires de Almada numa alçada crime em terras do sul do reino, para remediar certos roubos. A 10 de Outubro de 1500 substituiu Aires de Almada, então conselheiro régio, desembargador dos agravos e juiz dos feitos com cargo de chanceler mor, que estava doente. Entre os anos de 1500 e 1521, exerceu o cargo de desembargador e corregedor do crime na corte com poder e alçada, ou somente desembargador, em 1502 como deputado da provedoria dos hospitais e capelas de Lisboa e seu termo, sendo a já referida data de 1521, a mais tardia do trabalho no Juízo das Capelas, onde era desembargador a 7 de agosto de 1521. A 9 de Julho de 1533 foi nomeado conselheiro régio de D. João III, a somar aos cargos de desembargador e ouvidor da casa da Suplicação, cargo que exercia há muitos anos e recebeu mercê de se poder ausentar da corte, quando e para onde quisesse e aí receber os 100.000 reais de mantimento anual, que auferia pelo ofício de desembargador do Paço e petições.

Em 6 de abril de 1499 solicitou ao rei a mercê da administração da capela de Vasco Lourenço, seu tio-avô, instituída na igreja de S. Paio, Guimarães, tendo tomado posse dela a 1 de outubro de 1500. Instituiu morgado e comprou em 1515 os coutos de Abadim e Negrelos. Diogo Lopes fundou a parte mais antiga da casa: o corpo de um sobrado com fachada em pedra na rua de Val-Donas, que exibe uma janela de peitoril Manuelina no piso superior.

Fez o seu testamento de 2 de outubro de 1532 onde pediu para ser sepultado na igreja da freguesia onde falecesse e que as suas ossadas fossem depois transportadas para Guimarães. Pediu para ser sepultado no cruzeiro fora da capela da ermida de S. Sebastião, no Toural, juntamente com os seus pais, com uma cupa de pedra de Gonsa, com o escudo e suas armas e com o seguinte epitáfio: “Aqui foi enterrada a ossada do doutor Diogo Lopes de Carvalho foi doutor in utroque jure e desembargador na supricaçam e fez casa e morgado nesta vila”. O testamento foi aprovado em 10 de outubro de 1532. Ainda estava vivo em janeiro de 1541, pelo que terá falecido entre essa data e 1543, ano em que se procedeu ao inventário dos seus bens

1 parchment folio measuring 25+2.5x37 cm. with fold at the foot of the document, signed by King John III, with hanging seal with the royal arms faded, but with the corners still perceptible on careful reading.

The document is in good condition and presents the seal (round, in natural wax) very worn, difficult to read, with the qunas (five iner shields with five dots) faded, but nevertheless perceptible.

Royal charter from King João III granting the doctor Diogo Lopes de Carvalho, judge of High Court, permission to leave or return to his office whenever he wants, and to be absent from the Court whenever he wants, continuing always to receive his allowance as if he were continuously serving the courts. Évora, 9th July 1533.

Document transcription:

Dom João by the grace of God, King of Portugal and the Algarves from inner and outer sea [...] of the Suez [...] [Line 2] of the conquest, navigation and commerce, Ethiopia, Arabia, Persia and India etc. To all that see this letter of mine know that I [L. 3] have done grace to the doctor Diego Lopez de Carvalho judge of the office of my of the palace and his petitions with one hundred thousand reis(currency) of [L. 4] food per year as for provisions that I have ordered to give him. And taking into consideration the many services that the said doctor Diego Lopez has done and to the long time he serves and always very well and with all faithfulness to do [L. 6] more rest and relaxation I am pleased that when the said doctor wants to go from my court he may do so without needing any other license.[L. 7] and wherever he is the said one hundred thousand reis are paid to him entirely and as if he served at the said court and to the regent of the house of Suplicaçam I command that he be paid as if he continuously served on the post and when the said doctor wishes to return to serve the said office he may do so and if being at my court [L. 10] he does not wish to take petitions nor take them, he may do so. If he doesn't want to take petitions nor serve the said office it is fine that he does it and without prejudice of that there is the said maintenance because it pleases me [L. 11] that he serves the said office when he wants and takes the petitions he wants and the ones he doesn't want to take he doesn't take and [L. 12] when he wants to go and dispatch with the other court judges of the palace he can do it whether he goes or not always [. ...] the said [L. 13] maintenance at court and outside it wherever he may be, whether he serves the said office or does not serve as he sees fit and provided [L. 14] that he is outside my court and serves the said office for many years he shall enjoy all the privileges [L. 15] and freedoms as if he had been continuously serving at court and as those who [L. 16] serve have and enjoy them. And yet I command the said regidor that in what concerns him he fulfils it fully and therefore I command all my judges and justices to which it is shown that they keep the said privileges and freedoms fully, since [L. 17]. not in my court as well as if in it and serve with respect [...] [L. 18] I have therefore given him this letter signed by me and sealed with my pending seal [L. 19] to keep in his custody. Given in my city of [Leiria?] at 9 days in July. Fernam da Costa did so. Year of the birth of our Lord Jesus Christ, five hundred and thirty-three years.

Diogo Lopes de Carvalho (c. 1460 - c. 1541) Doctor in civil and canon law by the University of Coimbra, he was a jurist and performed the highest functions in the superior courts and in the Palace. He was, from 14th January 1499, judge of the Court and by special order judge of the hospitals and chapels and on 19th January of the same month and year judge of the hospitals and chapels in Lisbon and surrounding region, a post he had fully assumed in 1500. He accompanied, on August 26, 1499, D. Rodrigo de Castro and the licentiate Aires de Almada in a criminal court in the southern lands of the kingdom, to remedy certain robberies. On October 10, 1500 he replaced Aires de Almada, then king's counsellor, judge of the grievances and judge of the deeds with the office of chancellor mor, who was ill. Between 1500 and 1521, he held the office of judge and court corregidor of the crime at court with power and reach, or only judge, in 1502 as deputy of the purveyor of the hospitals and chapels of Lisbon and its term, being the already mentioned date of 1521, the later of the work in the Court of the Chapels, where he was judge on August 7, 1521. On 9th July 1533 he was nominated royal counsellor to King D. João III, in addition to the posts of judge and listener of the House of the Court, a post he had held for many years and was granted the grace to be able to absent himself from court whenever and wherever he wished and there receive the 100,000 reals annual salary he received for the office of judge of the Palace and petitions.

On April 6, 1499 he asked the king for permission to administer the chapel of Vasco Lourenço, his great-uncle, established in the church of S. Paio, Guimarães, and took possession of it on October 1, 1500. In 1515, he instituted a Majorat and bought the hunting grounds of Abadim and Negrelos. Diogo Lopes founded the oldest part of the house: the body of a two-storey house with a stone façade in Rua de Val-Donas, which displays a Manueline window sill on the upper floor.

He made his will on October 2, 1532 where he asked to be buried in the church of the parish where he died and that his bones be later transported to Guimarães. He asked to be buried in the cross outside the chapel of the hermitage of S. Sebastião, in Toural, together with his parents, with a stone with the shield and his arms and with the following epitaph: "Here were buried the bones of doctor Diogo Lopes de Carvalho who was doctor in utroque jure and judge in High Court and made house and manor in this town". The will was approved on October 10, 1532. He was still alive in January 1541, so he must have died between that date and 1543, the year in which an inventory of his estate was made.
