MANUSCRITO - SIGILOGRAFIA - SÉCULO XVII - CARTA PATENTE DO REI D. FILIPE II DE PORTUGAL. MERCÊ DO OFÍCIO DE JUIZ DOS ÓRFÃOS DE VISEU A JORGE MONTEZ DA FONSECA.

E per firmeza disso lhe mandei dar esta carta em Lisboa a Vinte de Novembro. El Rei Nosso senhor a mandou pelos doctores Luís Machado de Gouvêa e Francisco Vaz Pinto ambos do seu conselho e seus desembargadores do paço e Gastão Ferreira a fez Anno do nascimento de nosso Senhor Jesus Cristo de mil seiscentos e quinze. [Lisboa 20 de Novembro de 1615].

Uma folha de pergaminho de 30x42 cm. Com selo pendente de cera. Para melhor segurar a fita de tecido do selo foi feita uma dobra na margem inferior da folha, com entre 6 e 4 cm. na parte virada para cima e para a frente do documento.

Texto manuscrito com 24 linhas, letra castanha bela e muito definida ornamentada com elaboradas hastes algumas delas com as pontas cheias.

O selo de cera vermelha com 7,5x5,8 cm. tem rachas, vestígios de papel que se coloram à sua superfície e com pequeno bocado solto.

Documento de grande beleza e importância para o estudo do funcionamento da administração real da justiça durante a Dinastia Filipina, para a história da região de Viseu e para os estudos genealógicos das famílias envolvidas na transmissão e na concessão do ofício referido no documento.

A importância deste documento é ainda mais relevante pelo facto de as cartas régias da dinastia Filipina estarem muito pouco estudadas, não sendo referidas na História Genealógica de António Caetano de Sousa e na obra fundamental do Marquês de Abrantes - O estudo da Sigilografia, que só abrange a cartas régias da Idade Média, bem como pelo facto de documentos com o respectivo selo pendente serem muito mais raros do que outros tipos de documentos.

Do ponto de vista da diplomática esta carta régia tem a estrutura tripartida comum neste tipo de documentos. Em primeiro lugar o protocolo inicial que inclui a titulação Real, o endereço em que se refere a quem se dirige (o peticionário) e a todos os que a lerem.

Depois segue-se o Texto que inclui a transcrição de outro documento da Chancelaria Real que sustenta os direitos do requerente e a exposição que narra as causas do requerimento e factos que o sustentam. Segue-se a Dispositio em duas partes em que a primeira se inicia por: Ey por bem e mapraz e a segunda em que determina a todas as autoridades que cumpram a sua decisão: Mando ao provedor da Comarca da ditta Cidade de Viseu...Por fima Corroboração - Assi e minha mercê..

A terceira parte - o Protocolo final inclui a datação, a subscrição e a precação. No verso da folha de pergaminho constam outros documentos de validação desta nomeação que registam o cumprimento das ordens exaradas pelo Rei na carta Régia.

Do ponto de vista arquivístico é um documento composto, que além da carta régia, com todos os documentos de validação que lhe são próprios, inclui a transcrição do Alvará de 1594 e, no verso, a inscrição no Registo Geral das Mercês da Chancelaria Régia, o reconhecimento pela Câmara de Viseu, o registo do Juiz dos Órfãos de Viseu , em 14 de Junho de 1618.

Depois da intitulação é transcrito, desde a linha 3 até à linha 8, o Alvará elaborado por Francisco Matoso, em Madrid a 22 de Janeiro de 1594, concedendo a António Correia de Bulhões, Escudeiro Fidalgo da Casa Real, Cavaleiro da Ordem de Cristo e Juiz dos Orfãos de Viseu e seu termo, o direito de ceder o dito Ofício a um de seus filhos ou filhas.

Jorge Montez da Fonseca apresenta tal documento para poder tomar posse do cargo de Escrivão dos Órfãos de Viseu por se ter casado com a filha de António Correia de Bulhões, Helena Correa, e por o seu sogro ter renunciado ao cargo a favor dela conforme previsto no referido Alvará.

António Correia de Bulhões recebeu Carta de Brazão de Armas, em 12 de Março de 1589. Era Escudeiro Fidalgo da Casa Real, Cavaleiro da Ordem de Cristo.

Os Juízes dos Órfãos tinham grande importância devido à curta expectativa de vida da época acentuada pelas mortes em combate e em naufrágios em todos os vastos territórios do Império Português.

As Ordenações Manuelinas, dadas em 1514, prevêm (Livro I, Título 57), a existência de um juiz dos órfãos em todas as vilas e lugares que, com os respectivos termos, tivessem mais de quatrocentos vizinhos. Esses juízes mandariam, imediatamente, redigir o inventário de todos os bens dos órfãos, que iria sendo actualizado, quanto à receita e despesa, pelo escrivão dos órfãos. As Ordenações Filipinas, Livro I, Título 88, § 31, confirmam a existência de um juiz dos órfãos nas vilas e lugares com mais de quatrocentos vizinhos.

Competia ao juiz dos órfãos mandar proceder rapidamente à elaboração do inventário de todos os bens dos órfãos e ao depósito integral de todas as quantias pertencentes a estes numa arca, especialmente construída para o efeito, da qual seria depositário uma .pessoa abonada da respectiva vila ou lugar. Para além do dinheiro, seriam também guardados na arca "dois livros, um para receita, outro para despesa do dinheiro que se houver de meter e tirar dela". Esses livros seriam assinados pelo provedor da comarca e só poderiam ser tirados da arca quando fosse necessário escrever neles.

 MANUSCRIPT - SIGILLOGRAPHY – 17th. CENTURY - LETTER PATENT OF KING FILIPE II OF PORTUGAL. GRANT OF THE OFFICE OF JUDGE OF THE ORPHANS OF VISEU TO JORGE MONTEZ DA FONSECA.

And on that account I sent this letter to you in Lisbon on November 20th. El Rei Nosso Senhor (Our King) sent it by Luís Machado de Gouvêa and Francisco Vaz Pinto, both of his council, and Gastão Ferreira, who made it the year of the birth of our Lord Jesus Christ, one thousand six hundred and fifteen. [Lisbon 20th November 1615].

One sheet of parchment 30x42 cm. With wax seal pendant. To better hold the cloth ribbon of the seal a fold has been made in the lower margin of the sheet, between 6 and 4 cm. in the part facing up and to the front of the document.

Handwritten text with 24 lines, beautiful and very definite brown lettering ornamented with elaborate stems some of them with full tips.

The red wax stamp measuring 7.5x5.8 cm. has cracks, traces of paper staining to its surface and with small loose bit.

Document of great beauty and importance for the study of the functioning of the royal administration of justice during the Philippine Dynasty, for the history of the Viseu region and for genealogical studies of the families involved in the transmission and granting of the office referred to in the document.

The importance of this document is even more relevant due to the fact that royal charters of the Philippine dynasty are very little studied, not being mentioned in António Caetano de Sousa's História Genealógica and in the Marquês de Abrantes' fundamental work - O estudo da Sigilografia, which only covers royal charters from the Middle Ages, as well as the fact that documents with the respective pendant seal are much rarer than other types of documents.

From a diplomatic point of view this royal letter has the tripartite structure common in this type of documents. Firstly the initial protocol that includes the Royal title, the address in which it refers to who it is addressed to (the petitioner) and to all those who will read it.

Then follows the Text which includes the transcription of another document from the Royal Chancellery supporting the applicant's rights and the exposition narrating the causes of the application and facts supporting it. This is followed by the Dispositio in two parts, the first of which begins with: Ey por bem e mapraz and the second ordering all authorities to comply with its decision: Mando ao provedor da Comarca da ditta Cidade de Viseu... Finally the Corroboração.

The third part - the final Protocol includes the dating, the subscription and the precation. On the back of the parchment sheet are other documents validating this appointment which record compliance with the orders issued by the King in the Royal letter.

From an archival point of view it is a compound document, which in addition to the royal charter, with all its own validation documents, includes the transcription of the charter of 1594 and, on the reverse side, the inscription in the General Registry of Mercês of the Royal Chancellery, the recognition by the Chamber of Viseu, the registration by the Judge of the Orphans of Viseu , on 14 June 1618.

After the title is transcribed, from line 3 to line 8, the Charter drawn up by Francisco Matoso, in Madrid on 22 January 1594, granting António Correia de Bulhões, Nobleman Squire of the Royal House, Knight of the Order of Christ and Judge of the Orphans of Viseu and its term, the right to cede the said Office to one of his sons or daughters.

Jorge Montez da Fonseca presented this document in order to take possession of the office of Judge of the Orphans of Viseu because he had married António Correia de Bulhões' daughter, Helena Correa, and because his father-in-law had renounced his office in her favour as foreseen in the said Charter.

The Judges of the Orphans were of great importance due to the short life expectancy aat that time accentuated by deaths in battle and shipwrecks throughout the vast territories of the Portuguese Empire.

The Manueline Ordinances, given in 1514, provided (Book I, Title 57), the existence of a judge of the orphans in all villages and places which, with their respective terms, had more than four hundred people. These judges would immediately have an inventory of all the orphans' goods drawn up, which would be updated, as regards income and expenditure, by the clerk of the orphans. The Philippine Ordinances, Book I, Title 88, § 31, confirm the existence of a judge of the orphans in the villages and places with more than four hundred people.

It was up to the judge of the orphans to order the rapid drawing up of an inventory of all the orphans' goods and the depositing of all the amounts belonging to them in a chest, especially built for the purpose, of which a trustee would be a wealthy person from the respective town or place. Besides the money, there would also be kept in the chest "two books, one for income, the other for expenses of the money that is to be put in and taken out of it". These books would be signed by the District Provider and could only be taken out of the chest when it was necessary to write in them.
