In fólio de 31x21 cm. Com [viii], 332, [xii] págs. Encadernação inteira de pele, com nervos e ferros a ouro na lombada.

Impressão nítida com o texto em duas colunas ornamentado com cabeções constituídos por pequenas vinhetas tipográficas, em que o cabeção do início do terceiro tratado tem o trigrama sagrado ao centro rodeado por motivos vegetalistas, com iniciais decoradas com motivos vegetalistas e florões de remate sendo especialmente notáveis pela sua composição e dimensões o da página 225 e o da página final do índice e última do livro.

Exemplar com furos de traça na lombada, que foi restaurada, na charneira da pasta anterior, na pasta posterior onde atingem a folha de guarda e com os cantos das pastas danificados. Com cota de biblioteca escrita a lápis vermelho, na folha de guarda. Mancha de humidade à cabeça das últimas folhas, sublinhados em tinta coeva nas páginas 81-82, 289 e anotações manuscritas em letra coeva na 4.ª página do índice.

Conforme era comum nos trabalhos tipográficos da Península Ibérica até ao Séc. XVIII esta obra têm a pág. 309 numerada 302, mas está completa.

Edição raríssima. Barbosa Machado refere esta edição, mas não a viu, pois dá uma data errada - 1735. Na moderna edição desta obra (Gulbenkian, 2009) o ilustre especialista do direito antigo, prof. António Manuel Espanha também não conheceu esta edição, elencando apenas as outras de 1645, 1675, 1697, 1700 e 1745. A Porbase não tem qualquer exemplar catalogado desta edição. A Biblioteca da Ordem dos Advogados não possui exemplares. Não é referida nos principais catálogos de livreiros e de leilões de livros. Só é conhecido um exemplar na Biblioteca da Faculdade de Direito da Universidade de Coimbra.

As páginas preliminares contêm - Ad Lectorem, que é o prefácio do autor, carta do Doutor José de Abreu Bacelar, Vigário da Diocese de Coimbra e amigo do autor, o índice dos tratados e das questões neles estudadas, adições ao texto das páginas 71 e 79 e as licenças, datadas de 11 de Dezembro de 1731 a 10 de Dezembro de 1735. As páginas finais incluem um pormenorizado índice de assuntos.

Livro que inclui três tratados. O autor pensava escrever outro volume que nunca chegou a publicar. Os títulos são os seguintes: I - De gravaminibus, ou seja sobre os agravos e a distinção entre apelação e agravo; II - De Securitatibus, isto é acerca das cartas de seguro; III - De Inquisitionibus, sobre as inquirições.

Obra muito importante para o estudo do direito do Antigo Regime em Portugal, como o atestam as suas seis edições e a recente tradução acompanhada de estudo introdutório por António Manuel Hespanha.

Como explica Hespanha, no referido estudo, durante o Antigo Regime a maioria do corpo do direito era constituído pela tradição jurídica europeia - o Jus Commune, que era ensinado em todas as Faculdades de Leis e de Cânones da Europa e o resto era composto pelas leis próprias de cada reino. Mateus Homem Leitão chamou a esta obra - Sobre o direito Lusitano, pois nela explica certas questões próprias do direito de Portugal, que faziam parte das Ordenações, eram difíceis e sobre elas não existiam comentários explicativos e interpretativos, por serem particulares do Reino de Portugal e por vezes contrariarem o Jus Commune.

Mateus Homem Leitão (Braga, 1590? - 1658?) Membro de uma família de juristas e professores da Universidade de Coimbra. Doutor em Direito Canónico pela Universidade de Coimbra, onde integrou o Colégio Doutoral de S. Pedro e S. Paulo. Foi Familiar do Santo Ofício e Lente de Prima na Faculdade de Cânones. Posteriormente tornou-se Desembargador na Relação Eclesiástica de Braga e, ao mesmo tempo, exerceu as funções de Promotor e depois deputado da Inquisição de Coimbra. A partir de 17 de Março de 1646 foi Inquisidor em Évora, a partir de 02 de Novembro, 1649, Inquisidor de Coimbra e terminou a sua carreira de Jurista no Desembargo do Paço. Além desta obra escreveu e publicou outra obra: De Conscientia vera, et singulares observatio. Parisiis, apud Sebastianum Cramoisy, 1652.

Clear printing with the text in two columns decorated with headpieces made up of small typographic vignettes, in which the headpiece at the beginning of the third treatise has the sacred trigram in the centre, surrounded by plant motifs, with initials decorated with plant motifs and finishing fleurons, the one on page 225 and the one on the final page of the index and the last page of the book being particularly notable for their composition and size.

copy with moth holes in the spine, which has been restored, in the hinge of the front board, in the back board where they reach the endpapers, and with the corners of the boards damaged. With library shelf marking written in red pencil on the title page. Damp stain at the head of the last leaves, coeval underlining in ink on pages 81-82, 289 and handwritten coeval notes on the 4th page of the index.

As was common in typographical works in the Iberian Peninsula until the 18th century, this work has errors in page numbering, namely p. 309, numbered 302, but it is complete.

Rare edition. Barbosa Machado mentions this edition, but has not seen it, as he gives the wrong date - 1735. In the modern edition of this work (Gulbenkian, 2009), the illustrious specialist in ancient law, Prof António Manuel Hespanha, has not seen this edition either, listing only the others from 1645, 1675, 1697, 1700 and 1745. Porbase does not have any catalogued copies of this edition. The Bar Association Library has no copies. It is not mentioned in the main booksellers" and book auction catalogues. Only one copy is known to exist in the Library of the Faculty of Law of the University of Coimbra.

The preliminary pages contain - Ad Lectorem, which is the author"s preface, a letter from Doctor José de Abreu Bacelar, Vicar of the Diocese of Coimbra and friend of the author, the index of the treatises and the issues studied in them, additions to the text on pages 71 and 79 and the licences, dated from 11 December 1731 to 10 December 1735. The final pages include a detailed subject index.

This book includes three treatises. The author planned to write another volume, which he never published. The titles are as follows: I - De gravaminibus, i.e. on grievances and the distinction between an appeal and a bill of review; II - De Securitatibus, i.e. on letters of insurance; III - De Inquisitionibus, on inquests.

Very important work for the study of Ancien Régime law in Portugal, as evidenced by its six editions and the recent translation accompanied by an introductory study by António Manuel Hespanha.

As Hespanha explains in the aforementioned study, during the Ancien Régime the majority of the body of law was made up of the European legal tradition – the Jus Commune, which was taught in all the Faculties of Law and Canon Law in Europe, and the rest was made up of the laws of each kingdom. Mateus Homem Leitão called this work - Sobre o direito Lusitano (About Lusitan Law), because it explains certain issues specific to Portuguese law, which were part of the Ordinances, were difficult and on which there were no explanatory and interpretative comments, because they were particular to the Kingdom of Portugal and sometimes contradicted the Jus Commune.

Mateus Homem Leitão (Braga, 1590? - 1658?) Member of a family of jurists and professors at the University of Coimbra. He was a Familiar of the Holy Office and Lente de Prima at the Faculty of Canons. He later became a judge in the Ecclesiastical Court of Braga and, at the same time, served as a prosecutor and then deputy of the Coimbra Inquisition. From 17 March 1646 he was Inquisitor of Évora, from 2 November 1649 Inquisitor of Coimbra and ended his career as a jurist at the Desembargo do Paço. He also wrote and published other works: De Conscientia vera, et singulares observatio. Parisiis, apud Sebastianum Cramoisy, 1652.
